The Supreme Court of Pakistan appointed senior lawyers Munir A. Malik and Hamid Khan as judicial assistants in the contempt of court case for not scheduling the case of the powers of the benches, while also seeking assistance from the Attorney General of Pakistan. Justice Mansoor Ali Shah remarked that if the procedure committee withdraws cases while they are still running, the independence of the judiciary is lost. Where it is felt that the decision may be against the government, the case is withdrawn from the bench. A two-member bench headed by Justice Mansoor Ali Shah of the Supreme Court heard the contempt of court case for not scheduling the case of the powers of the benches. The Registrar of the Supreme Court appeared before the court. The court asked why the case was not scheduled despite the court order. The Registrar of the Supreme Court took the stand that this case belonged to the constitutional bench and was mistakenly assigned to the regular bench. Justice Aqeel Abbasi remarked that if this was a mistake, it had been going on for a long time. How did you realize it now? With apologies, the mistake was to include me only in this bench, I had heard this case in the High Court, Justice Mansoor Ali Shah inquired how the Practice and Procedure Committee met on this matter? Did the committee itself call the meeting or did you request it? The Registrar Supreme Court took the position that we had written a note to the committee, Justice Mansoor Ali Shah inquired why the note was written when there was a judicial order? Our order was very clear as to which bench the case should be heard.
The court made remarks, show us the note that you sent to the committee, on which the registrar presented the note sent to the committee. Justice Mansoor Ali Shah remarked that the mistake was not realized in this note. In it, you are writing that an order has been issued on January 16. You are asking to form a new bench based on this order. In the order, we had told which bench the case should be heard in. The registrar said that the Practice and Procedure Committee sent the case to the Constitutional Bench Committee. The Constitutional Benches Committee scheduled the cases related to the constitutional amendment on January 27. After the amendment, it was reviewed to see which cases could be scheduled in the bench and which could not. Justice Mansoor Ali Shah remarked that this case may have been left out of your hands by mistake, but once it reached the bench, the committee’s work was over. If the committee withdraws cases while they are in progress, the independence of the judiciary is over. Where it is felt that the decision may be against the government, the case itself is withdrawn from the bench. This case was left out of you and came before us. Finally, Allah Almighty must have designed a plan. Justice Aqeel Abbasi remarked that after hearing our case, at least the constitutional amendment case was fixed. Initially, there was a lot of noise, but the amendment case was not being fixed. Which constitutional amendment was to be reviewed in the tax case that this case was withdrawn?
